कंपनी ने पिछले दिनों कही थी एक्जिट ऑप्शन की बात
इसके तहत फिर आएगी स्कीम, पैनेलिस्टों को वापस होंगे पैसे
मल्टी लेवल मार्केटिंग के जरिए निवेशकों को करोड़ों रुपये का चूना लगानेवाली कंपनी स्पीक एशिया के खिलाफ जांच में आर्थिक अपराध शाखा (ईओडब्ल्यू) अभी तक कुछ खास नहीं कर पाई है। विभाग के अधिकारियों का कहना है कि कंपनी के अधिकारी जांच के दौरान झूठ बोल रहे हैं और ईओडब्ल्यू को गुमराह कर रहे हैं।
मुंबई ईओडब्ल्यू के एक वरिष्ठ अधिकारी ने बताया कि कंपनी के अधिकारी जिस तरह से एक्जिट ऑप्शन की बात कर रहे हैं, वह पूरी तरह गलत है। गौरतलब है कि स्पीक एशिया के पैनेलिस्टों को हाल में कंपनी के अधिकारियों ने कहा था कि वे सभी निवेशकों को एक्जिट ऑप्शन दे रहे हैं। साथ ही वे कंपनी की स्कीम फिर से शुरू कर रहे हैं और सभी पैनेलिस्टों को पैसे वापस मिलेंगे।
ईओडब्ल्यू के इस अधिकारी के मुताबिक कंपनी के शीर्ष अधिकारी के बारे में जो खबर मिली है, वह भी गुमराह करनेवाली है। इसमें विदेश में बैठी जिस 'कौर' नामक महिला को प्रमुख बताया जा रहा है, वह तो एकमात्र नाम है, इसके पीछे कोई और है। हालांकि अधिकारी ने उस शख्सीयत का नाम इसलिए नहीं बताया क्योंकि इससे जांच प्रभावित हो सकती है।
अधिकारी के मुताबिक हमारी जांच तो चल रही है और अदालती कार्यवाही में बराबर हम स्पीक एशिया के अधिकारियों के खिलाफ पक्ष रहे हैं। पर कंपनी के अधिकारी किसी भी तरह का सहयोग नहीं कर रहे हैं।
गौरतलब है कि इस मामले में अपराध शाखा पुलिस ने कई वरिष्ठ पैनलिस्टों के
साथ-साथ कंपनी के कुछ वरिष्ठ अधिकारियों को भी गिरफ्तार किया था। बाद में
कुछ को जमानत भी मिल गई थी। पर अब एक बार फिर से स्पीक एशिया के कुछ
पैनेलिस्ट निवेशकों को लालच दे रहे हैं।

The Serious Fraud Investigation Office (SFIO) is probing alleged scam perpetrated by MLM firm SpeakAsia, which is registered in Singapore.

Pilot said that small investors get hurt the most through such schemes, whose operators promise huge investment returns within short time periods. "These are the people who earn a few thousands of rupees and fall for such traps," he said.
When asked on how the MCA would be able to track these operators, as most of them are not even registered as companies, the minister said the tracking can still be done as money is involved and, therefore, they could be tracked through banking channels.
"But they (MLM firms) have to open a bank account and we can link it up. It is possible to do it (tracking them)," Pilot said.
According to the Minister, the government is making efforts to disseminate right information to people, especially the small investors, through the Investor Education Protection Fund (IEPF).
"Unless there is correct information, misinformation will take its place. There are enough people trying to swindle (money)... We need to give people the alternative investment products to make them understan what is wrong and and what is right," Pilot said.

About 87 companies have come under the government scanner for allegedly engaging in fraudulent MLM schemes
Corporate Affairs Ministry will hold a detailed review meeting this week to formulate ways to curb illegal Multi Level Marketing (MLM) investment schemes, amid rising instances of investor money being swindled through such activities.
"Some companies are known to misuse the MLM platform and I am concerned about it. I am taking a meeting this week on how we can track these companies, see if they are doing any irregularities and along with the state governments, come down heavily on them," Pilot told PTI in an interview.
"I want to have a comprehensive review within ministry to see where we stand and how far we have gone. We have had some representations in this regard and the meeting would discuss strong but educated and guarded steps needed to curb illegal MLM schemes because that is certainly a problem," he said.
About 87 companies have come under the government scanner for allegedly engaging in fraudulent MLM schemes and seven of them are being investigated for possible serious frauds.
Emphasising that there is no need for new regulations, Pilot said there needs to be certain control measures against the entities misusing MLM platform, but educating the investors is also necessary to safeguard them against false promises advertised by such companies.

Dear Panelist,
Further to our last update on the execution
of the exit policy. we wish to inform our SpeakAsia community that we have
finished analysing the results of the first test batch of payouts that were
sent.
We have identified certain roadblocks such as
multiple claimants to the same panelist id or bank details not matching with
the ones submitted at the time of applying for the exit policy, because of
which not everyone got the remittance in their accounts.
We are at this moment addressing those issues
and hope to have a resolution to them by the end of this month. Once we have
the resolutions in place we will then send out a second batch of test payouts. On
successful completion of this second batch we will commence the payout as per
the exit policy.

मिथक- काफी लोगों का मानना है कि माया कैलेंडर में 21 दिसंबर आखिरी तारीख है जिससे दुनिया खत्म हो जाएगी।
तथ्य-
भारतीय कैलेंडर 31 दिसंबर के बाद 1 जनवरी दिखाता है। उसी तरह माया कैलेंडर
एक चक्र की तरह चलता है। इसके बाद माया कैलेंडर अगली तारीख दिखाएगा। अंत
साल का होता है कैलेंडर का नहीं।
मिथक- निबरू ग्रह जो पृथ्वी से चार गुना बड़ा है वह पृथ्वी के काफी करीब आ जाएगा। इस के कारण सारी आपदा पृथ्वी पर आ गिरेगी।
तथ्य-
अगर ऐसा होता तो खगोलशास्त्री इस बात की जानकारी काफी पहले लगा लेते। अगर
यह ग्रह अदृश्य है तो इसके पृथ्वी से पास आने का असर पृथ्वी और बाकी के
ग्रहों पर साफ देखा जा सकता है। हर दिन इस बात की जांच कर रहे खगोलशास्त्री
हर दिन आसमान की जांच करते हैं।

तथ्य-
सौर तूफान ब्रह्मंड में होते है लेकिन 21 दिसंबर को किसी सौर तूफान की
जानकारी नहीं आयी है। अगला सौर तूफान मई 2013 में दिख सकता है लेकिन इससे
दुनिया खत्म हो जाएगी यह नहीं कहा जा सकता। हर ग्यारह साल बाद सूर्य की
उर्जा चर्म पर हो जाती है उससे सौर तूफान उत्पन्न होता है।
मिथक- 21 दिसंबर को पृथ्वी समेत सभी ग्रह सीधी रेखा में रहेंगे। जिससे ज्वारीय प्रभाव उत्पन्न होगा। यह पृथ्वी को नष्ट कर देगा।
तथ्य-
दिसंबर माह में कोई भी ग्रह सीधी रेखा में नहीं आएगा। अगर ऐसा होता भी है
तो पृथ्वी पर कोई ज्वारीय प्रभाव नहीं देखेने को मिलेगा।
मिथक- पृथ्वी की धुरी 21 दिसंबर को अपनी वास्तिविक जगह से हट जाएगी।
तथ्य- चंद्रमा के ग्रहपथ के कारण ऐसा संभव नहीं हो सकता। जिसके कारण पृथ्वी की धुरी अपनी जगह पर काबिज रहेगी।

पेनलिस्ट को ग़ुमराह करते रहे….धैर्य की शिक्षा देते रहे। जागो जागो
जागो…AISPA और SAOL दोनों ने मिलकर पेनलिस्टों की भावनाओं के साथ खिलवाड़
किया, अब हम इनके साथ जंग छेड़ेंगे
दोस्तों अब कम्पनी से पैसा वापस लेने के लिए मात्र एक ही उपाय बचा है और वो है सारे स्पीक एशियन मिलकर सरकार को ज्ञापन देना और ई0ओ0डब्ल्यू0 से मूलधन वापसी के लिए पूरा मदद करने की विनती करना, न कि कम्पनी रिस्टार्ट करवाने के लिए और इससे भी बात नहीं बनती है तो पूरे भारत भर मे धरना व प्रदर्शन करना जब तक सरकार पैसा वापसी करवाने के लिए हामी नहीं भर देती है
क्योंकि कम्पनीं की नीयत पैसा वापस करने की नहीं है इसलिए पैसा वापसी के लिए पूरे पेनलिस्टों का दबाव कम्पनी पर होना चाहिए तभी कुछ हो सकता है अन्यथा कम्पनी की चिकनी चुपड़ी बातों में आकर अब हम सबको कुछ भी नहीं हासिल होने वाला क्योंकि मेरे हिसाब से कम्पनी की नीयत में खोंट शुरु से ही थी और आज भी है और एक साजिश के तहत कम्पनी ने फ्राड किया है। इतना ही नहीं AISPA की भी पोल खुलनी चाहिए,
मेरे हिसाब से इसका गठन एक साजिश के तहत हुआ है और AISPA को उलझाकर रखने का काम सौंपा गया है, इसीलिए तो AISPA कम्पनी की कभी बुराई नहीं करती और आज तक इतने सारे लोगों की भावनाओं के साथ खिलवाड़ किया है। यदि हम अभी भी नहीं चेते तो ये सब हम लोगों की भावनाओं के साथ खेलते रहेंगे। हम बापी सरकार व उनके सहयोगियों का समर्थन करते हैं।
एक वक्त हुआ करता था जब दभास्कर.कॉम पर यदि कोई स्पीक एशिया के खिलाफ प्रतिक्रिया भी दर्ज कराता था तो लोग ताने मार-मार कर उसे घायल कर दिया करते थे और एक वक्त यह आया है कि 24 घंटे के भीतर दो-दो टीमें स्पीक एशिया एवं उसकी उसके पुनर्गठन के लिए बनाई गई ऑल इंडिया स्पीक एशिया पेनलिस्ट एसोसिएशन का खुले विरोध पर उतर आईं हैं।
अभी हाल ही में मिले एक नए मेल में पेनलिस्ट मनोज कुमार ने बापी सरकार के विरोध का समर्थन करते हुए जंग का एलान किया है। उनका मानना है कि एसोसिएशन का गठन पेनलिस्ट को बरगलाने के लिए किया गया है ताकि देश भर में संभावित कानूनी कार्रवाईयों को रोका जा सके और धीरे धीरे लोग स्पीक एशिया को भूल जाएं, साथ ही अपने मूलधन को भी।

SPEAKASIA ???RBI imposes Rs 5 lakh penalty on Abhyudaya Co-operative Bank
The Reserve Bank of India has imposed a monetary penalty of Rs 5 lakh on Mumbai-based Abhyudaya Co-operative Bank for violation of its instructions/ guidelines. A special scrutiny conducted in the Vashi branch of the bank to check the operations in the account of M/s Speak Asia Online Private Ltd , an online survey company, had revealed that the bank had violated KYC/AML guidelines, the Central Bank said in a statement. “The bank had also violated instructions by freezing the account and thus tipping off the customer. It had also closed the audit trail by closing the account,” said the RBI. The Central Bank observed that the bank had not adhered to KYC/AML guidelines on an earlier occasion involving RTGS transactions with Union Bank of India, Zaveri Bazar Branch. Thus, there was evidence of recurrence of non-compliance in implementation of KYC norms, it added. The RBI had issued a show cause notice to the bank, in response to which the bank submitted a written reply. After considering the facts of the case and bank’s reply in the matter, the RBI came to the conclusion that the violations were substantiated and classified as ‘Major’ which warranted imposition of penalty, said the statement.

appears for the Speak Asia Online Pvt.Ltd, pursuant to a notice
given by the applicant.

2 The learned counsel for the applicant points out that though
the learned Special P.P had consented on the last date of hearing
that the applicants interrogation by, or interviews with the
Investigating Officer would be video recorded, actually the
applicant was not called at all thereafter for interrogation.
Mr.Gharat submits that the applicant was called yesterday i.e. on 16
December 2012 and that the applicant, at that time, came to the
office of the EOW along with the videographer and submitted that
the chip of the recording would be taken by the applicant.
According to Mr.Gharat, therefore, the Investigating Agency now
does not agree that the interrogation or interview of the applicant
by the Investigating Officer should be allowed to be video recorded.
3 Mr.Gharat also does not agree to the suggestion that the
recorded chip may be kept by the Investigating Agency in a sealed
cover and submits that he had agreed for the video recording of the
interrogation in the peculiar facts and circumstances as existed on 7
December 2012, and now the Investigating Agency no more agrees
for such a suggestion. Thus, in other words, the investigating
agency is now not ready to keep a record of the interrogation in the
form of video recording.
4 Mr.Gharat also submits that the Company 'Speak Asia Online
Pvt.Ltd' would have no say in the matter. In this regard, it may be
observed that when a prayer that he be allowed to give a notice to
the said company was made before the Court on the last date, the
Investigating Agency had not objected to such a course being
adopted. In any case, it would be for the Court to decide whether

hearing the said company would be necessary for a proper
determination of the present Anticipatory Bail Application. It
cannot, at this stage be said that a company should not be given any
audience even if it voluntarily comes forward to make submissions
on certain relevant aspects, on the basis of notice given by the
applicant.
5 In spite of these differences between counsel for the applicant
and the learned Spl.P.P, they both agree that the final hearing of the
